Welcome to EverythingNZ! These Terms and Conditions govern your use of our website (everythingnz.co.nz) and your purchases from our online store. By accessing our site or placing an order, you agree to the following terms. Please read them carefully. If you do not agree, you may not use our services. We try to keep things fair and straightforward. Should you have any questions about these terms, feel free to contact us.

1. Use of Our Website and Services

  • Eligibility: To make a purchase, you should be at least 18 years old or using the site under the supervision of a parent or guardian. By placing an order, you confirm that you are legally capable of entering into a binding contract.

  • Accurate Information: You agree to provide accurate, current, and complete information when creating an account or placing an order. For example, please double-check your delivery address and email. We are not responsible for issues (like missed deliveries) caused by incorrect details you provided.

  • Account Security: If you create an account on our website, you are responsible for keeping your login credentials confidential. You must notify us immediately of any unauthorized use of your account. You’re responsible for all activities that occur under your account.

  • Lawful Use: You agree to use our website only for lawful purposes. Do not attempt to interfere with the site’s operation or commit fraud. Any attempt to compromise our website’s security or to use our site for fraudulent activity will result in termination of your access and may lead to legal action.

  • Prohibited Conduct: You must not misuse the website (for example, by introducing viruses, spamming, or using automated bots to scrape data). You also agree not to use any content from our site for commercial purposes without permission.

2. Placing Orders & Order Acceptance

  • Order Process: When you place an order on EverythingNZ, you will first receive an email confirmation acknowledging that we received your order. This email does not yet signify acceptance of your order; it’s an acknowledgement. We officially accept your order and form a contract of sale when we dispatch the product to you.

  • Right to Cancel or Refuse: We reserve the right to cancel any order or refuse service to anyone, at our discretion. Some situations where we might cancel an order include: the product is out of stock, a pricing error or description error is identified, the order did not pass our payment security checks, or we suspect fraudulent or unlawful activity. If we cancel your order, we will notify you and refund any payment you’ve made.

  • Pricing Errors: We do our best to ensure all product prices and information on our site are accurate. However, errors can occur. If we discover a pricing mistake in your order, we will inform you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we cannot reach you, we may treat the order as cancelled. If you have already paid, you’ll receive a full refund in case of cancellation due to a pricing error.

  • Product Descriptions: We strive to display and describe items as accurately as possible. However, slight variations in color or design may occur (for example, due to different display screens). If a product you receive is significantly not as described, you are entitled to return it (see our Refund Policy above). Minor differences that do not affect the use of the product will not usually be considered misrepresentation.

  • Stock Availability: All orders are subject to availability. Some items may sell out quickly or have limited stock. If an item is unavailable after you’ve ordered, we will let you know and remove it from your order (or offer an alternative if one is available). You’ll be refunded for any item that is not available.

3. Payment Terms

  • Prices and Currency: All prices on EverythingNZ.co.nz are listed in New Zealand Dollars (NZD) and include GST (Goods and Services Tax) where applicable, unless stated otherwise. Any shipping fees will be added at checkout. We reserve the right to change prices at any time, but once you’ve ordered, the price you paid will not change (except in case of a clear error, as noted above).

  • Payment Methods: We accept several payment methods for your convenience. These include major credit and debit cards (Visa and Mastercard), as well as buy-now-pay-later options like Afterpay and Klarna. When paying by Afterpay or Klarna, you agree to their terms and conditions in addition to ours.

  • Payment Security: Payments on our site are processed securely via reputable payment gateways. Your credit card information is encrypted and handled following industry standards. If using Afterpay or Klarna, your payment agreement is directly with them and they will handle your payment schedule.

  • Billing Issues: If your payment method is declined or there’s an issue with the transaction, we will not be able to process your order. Please ensure your card details are correct and you have sufficient funds. If you encounter issues, you can try a different payment method or contact us for assistance.

4. Shipping & Delivery

(For full details, please refer to our Shipping Policy above.) By placing an order, you acknowledge and accept our shipping terms:

  • We currently ship within New Zealand only. You must provide a valid NZ shipping address.

  • Delivery times are estimates (usually 7–15 business days after dispatch). While we aim to meet these, there could be delays outside our control.

  • Title and risk in the goods pass to you upon delivery. This means once delivered, the products are your responsibility. If a package is lost or damaged in transit, we will work with you to resolve it per our policies.

  • You agree that we may share your contact and address details with our third-party shipping partners and suppliers strictly for fulfilling your order.

5. Third-Party Suppliers and Links

EverythingNZ may feature products provided by third-party suppliers (dropshippers). While we handle customer service and sales, some products are shipped directly from the supplier. We hold our partners to high standards of quality and reliability. However:

  • We are not liable for any supplier’s delays or errors, beyond our commitment to make it right for you as described in our Refund and Shipping policies.

  • Any third-party links on our site (for example, to manufacturer websites or informational blogs) are provided for convenience. We do not have control over content on those third-party sites and cannot take responsibility for them. Accessing external links is at your own risk, and you should read their terms/privacy policies.

6. Intellectual Property

  • Website Content: All content on the EverythingNZ website – including text, product images, graphics, logos, button icons, and software – is the property of EverythingNZ or our content suppliers and is protected by copyright, trademark, and other intellectual property laws.

  • Trademarks: “EverythingNZ” and our logo are trademarks of our company. Other trademarks shown on our site (such as product brand names or payment service logos like Visa, Afterpay, Klarna) are property of their respective owners.

  • Your Use of Content: You are welcome to browse, view, and print pages from our site for your personal use. However, you may not copy, reproduce, republish, upload, distribute, or exploit any portion of the site for commercial purposes without our express written consent. For example, you cannot scrape our product listings to display on your own site, or use our photos in your marketing, unless you have permission.

  • Feedback: If you send us suggestions or feedback (e.g. ideas to improve products or our website), you agree that we can use and implement that feedback without obligation to you. Any such feedback is given voluntarily.

7. Limitation of Liability

  • General Liability: We work hard to ensure a great experience, but if something goes wrong, EverythingNZ’s liability to you is limited. To the fullest extent permitted by New Zealand law, we will not be liable for any indirect, incidental, special, or consequential losses or damages arising from your use of our website or purchase of our products. This includes, for example, loss of data, loss of income or profit, or claims by third parties.

  • Maximum Liability: In all cases, our total liability is capped at the amount you paid for the product or service in question. In simple terms, we are responsible for providing the product or a refund if something goes wrong, but we are not responsible for additional damages or costs.

  • No Warranty for Website: The EverythingNZ website is provided on an "as is" and "as available" basis. We do not guarantee that the site will be uninterrupted, error-free, or free of viruses. While we strive for accuracy, we do not warrant that product descriptions or other content is completely error-free or up-to-date. If we find a material error in the content, we will fix it as soon as possible.

  • Consumer Rights: Nothing in these terms is intended to exclude or limit any legal rights you have under New Zealand law (such as under the Consumer Guarantees Act 1993 or Fair Trading Act). Our limitations of liability apply only to the extent allowed by law​

In plain language, if you misuse our site or violate the rules and that causes a problem, you need to cover the costs that result.

These Terms & Conditions and any separate agreements whereby we provide you services or sell you products shall be governed by and interpreted in accordance with the laws of New Zealand.
